Partner Terms

These Partner Terms apply to all surf camps, schools, and stays (“Partners”) listed on SurfPortugal. By accepting a listing on SurfPortugal — through the onboarding process, email confirmation, or continued use of the platform — Partners agree to these Terms.

1. Listing Accuracy

  • Partners must provide accurate, current information: pricing, availability windows, inclusions, skill level requirements, group sizes, cancellation policies, and any mandatory prerequisites (e.g., swimming ability, minimum age).
  • If any material detail changes (pricing, availability, inclusions), Partners must notify SurfPortugal within 5 business days: hello@surfportugal.com.
  • Deliberately misleading or false listing information is grounds for immediate delisting.

2. Response SLA

  • Booking requests: Partners must confirm or decline availability within 48 hours of receiving a booking request notification, or within 24 hours during peak season (June–September).
  • Tourist inquiries: Partners must reply within 72 hours.
  • Repeated failures to meet response SLAs may result in the Partner being deprioritised in recommendations or suspended.

3. Confirmed Bookings

  • Once a Partner confirms availability and the tourist pays a reservation deposit, the Partner is obligated to honour the booking unless force majeure applies.
  • Partners must not cancel confirmed bookings for commercial reasons (e.g., receiving a higher-value booking elsewhere).
  • If a Partner must cancel a confirmed booking, they must notify SurfPortugal immediately. The tourist will receive a full deposit refund, and the Partner may be charged a cancellation penalty at SurfPortugal’s discretion.

4. Deposit Economics and Commission

  • SurfPortugal collects a reservation deposit from the tourist and retains a platform coordination fee. The remainder (if any) is settled with the Partner per the agreed commercial terms.
  • Commission rates and deposit amounts are agreed at the time of Partner onboarding and may be revised by SurfPortugal with 30 days’ notice.
  • The remaining balance (total minus deposit) is collected directly by the Partner from the tourist and is not processed by SurfPortugal.

5. Partner Cancellation Policy Alignment

  • Partners must publish their own cancellation policy for the remaining balance (the portion they collect directly). This policy must be shown on the listing and acknowledged by tourists before deposit payment.
  • Partners’ cancellation policies must not be materially harsher than SurfPortugal’s standard policy for the deposit portion. Any discrepancy that disadvantages tourists may be grounds for delisting.

6. Data Protection

  • Tourist contact details (name, email, WhatsApp) are shared with Partners only after deposit payment, as detailed in the Privacy Policy.
  • Partners must handle tourist data in compliance with GDPR and applicable Portuguese law. Tourist data received from SurfPortugal may only be used to deliver the booked service.
  • Partners must not use tourist data for marketing without the tourist’s explicit consent, independent of SurfPortugal’s platform.

7. Code of Conduct

  • Partners must treat tourists, SurfPortugal staff, and other Partners with respect.
  • Partners must hold valid business registration, appropriate insurance, and any licences required by Portuguese law to operate surf instruction or accommodation.
  • Partners must not offer bribes, incentives, or artificial reviews to influence their listing ranking or customer ratings.

8. Verification and Audits

  • Featured Partners are re-verified by SurfPortugal monthly; Standard Partners quarterly.
  • SurfPortugal reserves the right to request supporting documentation (insurance certificates, business licence) at any time. Failure to provide requested documentation within 10 business days may result in suspension.

9. Suspension and Delisting

SurfPortugal may suspend or delist a Partner for:

  • Persistent SLA breaches or unresponsiveness.
  • Cancelling confirmed bookings without force majeure.
  • Complaints from tourists substantiated by SurfPortugal investigation.
  • Material listing inaccuracies or fraud.
  • Failure to maintain required business licences or insurance.

In cases of serious misconduct, delisting is immediate and without notice.

10. Governing Law

These Partner Terms are governed by the laws of Portugal.
